In a significant pre-trial development, Lil Durk has secured a legal victory as a federal judge granted his motion to sever new gang-related charges from his high-profile murder-for-hire case. The ruling marks a pivotal moment in the ongoing legal proceedings, ensuring that the rapper’s upcoming trial remains focused on the original charges.

According to court documents obtained on Tuesday, July 14, Judge Michael W. Fitzgerald approved the motion to exclude newly added racketeering charges that prosecutors had linked to alleged OTF (Only The Family) gang activity in Chicago. The prosecution had sought to introduce evidence concerning a 2019 Atlanta shooting and a 2022 Chicago murder into the current proceedings. However, the court maintained that the trial, currently scheduled for an August 20 start date, will proceed as planned without the inclusion of these additional counts.

In a statement regarding the court’s decision, Drew Findling, the attorney representing the Chicago artist, expressed satisfaction with the outcome. “We are very happy with the court’s order. For 21 months, we have been unwavering in our commitment to Mr. Banks and his innocence and look forward to an Aug. 20, 2026, trial,” Findling stated.

The judge’s decision followed a contentious pre-trial hearing in Los Angeles, where he reportedly admonished prosecutors for their attempt to expand the scope of the case. Judge Fitzgerald expressed skepticism regarding the prosecution’s strategy, noting that adding the racketeering charges while simultaneously requesting a trial delay appeared to be an attempt to gain an unfair tactical advantage. “You think you will have a better chance to win if the Chicago count is tried with the Los Angeles murder. That’s obvious,” the judge remarked during the hearing. “You treat that as a feature. I treat that as a bug.”

Ultimately, the court determined that a more streamlined approach—focusing exclusively on the Los Angeles murder charge—would be the most appropriate path forward. The potential for a second trial regarding the Violent Crimes in Aid of Racketeering (VICAR) counts remains a possibility for a later date. Lil Durk, born Durk Devontay Banks, has been in custody since October 2024 following his arrest in connection with the 2022 killing of Saviay’a “Lul Pab” Robinson.
